{"id":20864,"date":"2020-02-04T00:00:00","date_gmt":"2020-02-04T00:00:00","guid":{"rendered":"https:\/\/www.guidaeuroprogettazione.eu\/what-are-the-effects-of-brexit-on-european-projects\/"},"modified":"2025-01-10T16:30:15","modified_gmt":"2025-01-10T16:30:15","slug":"what-are-the-effects-of-brexit-on-european-projects","status":"publish","type":"post","link":"https:\/\/euknow.it\/en\/what-are-the-effects-of-brexit-on-european-projects\/","title":{"rendered":"What are the effects of Brexit on European projects?"},"content":{"rendered":"\n<p>We continue the analysis of the Brexit process <a href=\"https:\/\/euknow.it\/brexit-2020-1\/\">begun in a previous post<\/a> with an interesting and timely insight: what, operationally, will be <strong>the effects of Brexit on European projects<\/strong>?<\/p>\n\n<p>The main distinction in answering the question is between <strong>an exit without an agreement between the UK and the EU<\/strong> (&#8220;no deal&#8221;) and <strong>an exit governed by an agreement<\/strong> (at the moment, we consider the most recent version of the October 2019 agreement).<\/p>\n\n<p><!--more--><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The case of Brexit with &#8220;no deal&#8221;<\/strong><\/h2>\n\n<p>It is most likely that British organizations will be treated as <strong>&#8220;third country&#8221; organizations<\/strong> as early as the projects currently underway or being submitted.<\/p>\n\n<p>A UK lead entity therefore risks <strong>becoming ineligible for funding and grants<\/strong> under community programs, creating potential problems for the entire partnership.<\/p>\n\n<p>Similar problems could exist for partnerships that include a British entity, particularly where program rules <strong>limit participation to EU member states<\/strong> or require <strong>a minimum number of member state organizations<\/strong> to <strong>participate<\/strong>. In this sense, the rules could change depending on the programs and individual calls.<\/p>\n\n<p>However, to deal with this eventuality and for projects already underway, the British government has established a <a href=\"https:\/\/www.gov.uk\/government\/publications\/the-governments-guarantee-for-eu-funded-programmes-if-theres-no-brexit-deal\/the-governments-guarantee-for-eu-funded-programmes-if-theres-no-brexit-deal\" target=\"_blank\" rel=\"noopener\">guarantee fund<\/a> to <strong>cover European funding that would be lost with Brexit<\/strong> in the event of a &#8220;no deal.&#8221;<\/p>\n\n<p>A<a href=\"https:\/\/www.gov.uk\/guidance\/european-and-domestic-funding-after-brexit\" target=\"_blank\" rel=\"noopener\">special page<\/a> lists the government departments responsible for continuity of funding for various <a href=\"https:\/\/euknow.it\/guida\/guida-europrogettazione\/programmi-comunitari\/\">community programs<\/a> and the contacts (or portals) for beneficiaries. Specific pages are devoted to the registration of those potentially interested in this guarantee fund: for  <a href=\"https:\/\/apply-for-innovation-funding.service.gov.uk\/eu-grant\/overview\" target=\"_blank\" rel=\"noopener\">Horizon2020<\/a>, for the  <a href=\"https:\/\/www.gov.uk\/government\/publications\/delivering-overseas-aid-programmes-if-theres-no-brexit-deal\" target=\"_blank\" rel=\"noopener\">Cooperation programs with third countries<\/a>, for other  <a href=\"https:\/\/www.gov.uk\/guidance\/register-as-an-organisation-getting-funding-directly-from-the-eu\" target=\"_blank\" rel=\"noopener\">Community<\/a> Programs, for <a href=\"https:\/\/www.gov.uk\/government\/publications\/european-territorial-cooperation-funding-if-theres-no-brexit-deal\" target=\"_blank\" rel=\"noopener\">Territorial Cooperation Programs<\/a>, for Structural Funds<a href=\"https:\/\/www.gov.uk\/guidance\/european-social-fund-esf-after-brexit\" target=\"_blank\" rel=\"noopener\">(ESF<\/a> and <a href=\"https:\/\/www.gov.uk\/guidance\/european-regional-development-funding-erdf-after-brexit\" target=\"_blank\" rel=\"noopener\">ERDF<\/a>) and for funding in the <a href=\"https:\/\/www.gov.uk\/government\/publications\/farm-payments-if-theres-no-brexit-deal\" target=\"_blank\" rel=\"noopener\">agricultural sector<\/a>.<\/p>\n\n<p>We also recommend a page devoted to the possible <a href=\"https:\/\/www.gov.uk\/government\/publications\/uk-participation-in-horizon-2020-uk-government-overview\/uk-participation-in-horizon-2020-after-brexit#minimum-eligibility-requirement\" target=\"_blank\" rel=\"noopener\">effects of Brexit<\/a> on <strong>Horizon2020 projects<\/strong>: useful (in addition to those interested in this program) as a practical example of the criteria that could be applied to any funding line.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The case of &#8220;regulated&#8221; Brexit<\/strong><\/h2>\n\n<p>Referring to the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/IT\/TXT\/PDF\/?uri=CELEX:12019W\/TXT(02)&amp;from=IT\" target=\"_blank\" rel=\"noopener\">most recent version of<\/a> the agreement, the answer is simpler: in principle, British organizations will be able to <strong>continue to participate normally in projects <\/strong>in the current programming period (2014-2020), while they will have the <strong>status of &#8220;third country organizations&#8221; <\/strong>for projects in the next programming period<strong>(2021-2027<\/strong>).<\/p>\n\n<p>We cite, in this regard, the following articles of the said agreement:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><em>\n  <strong>Article 137 <\/strong>\n<\/em>&#8220;[&#8230;] Union programs and actions committed under the Multiannual Financial Framework for the period 2014-2020 (&#8220;MFF 2014-2020&#8243;) or the previous Financial Perspective, shall be executed in 2019 and 2020 as far as the United Kingdom is concerned under the applicable Union law.&#8221;<\/li>\n<li><strong>\n  <em>Article 132<\/em>\n<\/strong> &#8220;[&#8230;] the United Kingdom shall be considered a third country for the purpose of the implementation of Union activities and programs committed under the multiannual financial framework that applies from 2021.&#8221;<\/li>\n<\/ul>\n\n<p>It is likely that the general provisions of the next programming period, as well as those specific to the relevant programs and calls, will contain clearer guidance regarding the eligibility of British organizations.<\/p>\n\n<p><strong>Specific collaboration arrangements<\/strong> could then be made <strong>with the UK<\/strong>, similar to those that allow participation in some European Programs by <a href=\"https:\/\/it.wikipedia.org\/wiki\/Associazione_europea_di_libero_scambio\" target=\"_blank\" rel=\"noopener\">EFTA<\/a>, <a href=\"https:\/\/it.wikipedia.org\/wiki\/Spazio_economico_europeo\" target=\"_blank\" rel=\"noopener\">EEA<\/a> and <a href=\"https:\/\/it.wikipedia.org\/wiki\/Allargamento_dell%27Unione_europea#Candidati_ufficiali\" target=\"_blank\" rel=\"noopener\">pre-accession<\/a> countries.<\/p>\n\n<p>In any case, as things stand, the <a href=\"https:\/\/ec.europa.eu\/info\/funding-tenders\/opportunities\/portal\/screen\/support\/faq;keywords=\/3269\" target=\"_blank\" rel=\"noopener\">European Commission&#8217;s guidance<\/a> confirms that <strong>no discrimination is made<\/strong> in the evaluation of proposals on the basis of the (British) nationality of the proponents and Brexit-related considerations.<\/p>\n\n<p>Certainly all of this complicates the work of those who work and develop projects with UK organizations&#8230;
